What is a Protective Award Claim?

If you were not consulted with properly prior to your redundancy and more than 20 employees (in one workplace) were made redundant, you will be eligible to pursue a protective award claim, which can award compensation of up to 90 days’ pay.

You will be eligible to pursue a protective award claim if your employer did not consult with a recognised trade union or elected representatives prior to your redundancy and did not follow the correct notice requirements prior to your redundancy. You should have been notified of your redundancy at least 30 days prior to dismissal if (if 20-99 employees were made redundant in your workplace), or 45 days prior to your dismissal (if 100+ were made redundant in your workplace).

A protective award claim is separate from the statutory redundancy claim. So, if you are eligible for this claim, you could receive two separate payouts on your redundancy.

How much could I be awarded?

You could be awarded 90 days’ pay on your protective award claim.

However, in the event that your employer cannot pay your award, the Government guarantees 8 weeks’ pay, capped at £544 per week, less any arrears of pay you may have received from the Redundancy Payments Office. So in this situation, you could receive up to £4,352.
